Terms of Service

1. Service Description

Optimum7 Backup Tool provides automated backup and restore functionality for BigCommerce stores. The Service enables you to create, store, browse, download, and restore backups of your store's data, including products, customers, orders, and other resource types.

Feature availability depends on your subscription plan. Certain features (such as one-click restore and sandbox testing) are available only on the Pro plan.

2. Eligibility and Account

You must have a valid BigCommerce store account to use the Service. By installing the app, you represent that you are authorized to act on behalf of the store.

You are responsible for maintaining the security of your BigCommerce account and for all activity that occurs through your connection to the Service.

3. Subscription and Payment

• The Service is offered on a monthly subscription basis. Current pricing is displayed on the Settings > Subscription page within the app.
• Subscriptions automatically renew each billing period. You may cancel at any time through the Billing Portal in the app.
• Payments are processed by Stripe. By subscribing, you agree to Stripe's terms of service.
• If a payment fails, your subscription will be suspended and access to the Service will be blocked until payment is resolved.
• Upon cancellation, your subscription remains active until the end of the current billing period. After cancellation, you retain read-only access to your backups for 30 days.

All prices are in USD. We reserve the right to change pricing with 30 days' notice.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of BigCommerce's terms.
• Attempt to reverse-engineer, decompile, or extract source code from the Service.
• Use the Service to access or back up data belonging to stores you do not own or are not authorized to manage.
• Interfere with the normal operation of the Service or its infrastructure.
• Resell or sublicense access to the Service without written permission.

5. Data Ownership and Responsibility

You retain ownership of all data backed up through the Service. We do not claim any rights over your store data.

You are solely responsible for verifying the accuracy and completeness of backups before initiating restores. We strongly recommend testing restores on a sandbox store before applying to production.

We are not responsible for data loss resulting from your use of the restore functionality, including partial restores, overwritten data, or incompatible schema changes in BigCommerce.

6. Limitation of Liability

The Service is provided “as is” without warranties of any kind, express or implied. We do not warrant that the Service will be error-free, uninterrupted, or that all backup operations will succeed.

To the maximum extent permitted by law, Optimum7 (Optimum Web Marketing Consultants LLC) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or profits, arising out of or related to your use of the Service.

Our total cumulative liability to you for any claims arising from or related to the Service shall not exceed the amount you paid for the Service in the three months preceding the claim.

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may perform scheduled maintenance with reasonable notice. We are not liable for downtime caused by third-party services (BigCommerce, DigitalOcean, Stripe) or events beyond our control.

8. Termination

You may terminate your use of the Service at any time by canceling your subscription and uninstalling the app from your BigCommerce store.

We reserve the right to suspend or terminate your access to the Service for violation of these Terms, non-payment, or abuse of the Service, with or without notice.

9. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting a notice within the app or by email. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

10. Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Miami-Dade County, Florida.
